Violation of the rights of prisoners of war

Analysis of violations of the rights of civilians and prisoners of war during the Israeli-Palestinian conflict against the background of the October 2023 escalation

The escalation of the Israeli-Palestinian conflict in October 2023 became one of the most destructive events in the region in recent decades. Large-scale attacks by both sides led to significant civilian casualties and violations of the rights of prisoners of war. Both Palestinian and Israeli civilians became victims of violence and gross human rights violations. The summary data examines the key aspects of the conflict, including hostage-taking, humanitarian crises, and human rights violations with corresponding statistics.

During the terrorist attacks of October 7, 2023, which occurred amid a brutal assault by Hamas terrorists on Israel, the death toll was 1,139: 695 Israeli civilians (including 38 children), 71 foreign citizens, and 373 security personnel. These figures were published in December 2023 using social security data. Another 251 people were taken hostage during the initial attack on Israel in the Gaza Strip. Another 479 Palestinians, including 116 children, and 9 Israelis were killed in the occupied West Bank (including East Jerusalem). Additionally, five people are considered missing, including four Israelis.

The situation of civilians and prisoners during the escalation

Civilians

Civilians on both sides of the conflict suffered significant losses and hardships during the October escalation.

Victims among Israeli civilians: According to official figures, as a result of Hamas attacks on Israeli territory, more than 1,400 Israeli civilians, including 200 children, were killed. Thousands were injured, many of whom were left disabled.

Victims among Palestinian civilians: At the same time, Israeli airstrikes on the Gaza Strip resulted in the deaths of over 4,300 Palestinian civilians in the first three weeks of October 2023. Among the dead were about 1,100 children and more than 800 women. Thousands more were wounded and in need of urgent medical assistance. According to the latest data, nearly a year of war between Israel and Hamas has claimed the lives of 41,000 Palestinians and left more than 93,000 wounded.

Humanitarian crisis in the Gaza Strip: The blockade and destruction of infrastructure led to a humanitarian catastrophe. According to the UN, about 1.7 million people were forced to flee their homes, and more than 2 million were left without access to clean water and medical services.

Prisoners of war and civilian hostages captured by Hamas

The escalation of the conflict was accompanied by numerous violations of the rights of prisoners of war and civilians.

Civilian hostages during the October escalation of 2023: During the escalation of the conflict in October 2023, Hamas captured a significant number of civilians, causing international outrage and numerous calls for their release. According to Israeli sources, the total number of civilian hostages exceeded 240, including about 60 children. These hostages became critical elements in the negotiations between Israel and Hamas, which intensified tensions in the region. This created enormous humanitarian pressure on Israeli society, as well as concerns for the safety of families whose children had been taken hostage. At the same time, international organizations such as the Red Cross demanded that Hamas provide information on the whereabouts of the hostages and ensure they were held in proper conditions.

The situation with civilian hostages became one of the most acute issues in the conflict, contributing to the worsening humanitarian crisis in the region and leading to international pressure on both sides to reach a peaceful resolution. The efforts of international organizations have focused on the release of hostages and the protection of their rights, but amid ongoing hostilities, the implementation of these efforts remains extremely difficult.

Capture of Israeli soldiers and civilians: During the October attack, Hamas captured about 240 Israeli soldiers and civilians, including women and children. These hostages became key elements in the negotiations between Hamas and Israel.

Palestinian prisoners and detainees: According to human rights organizations, Israel holds about 5,500 Palestinian prisoners, of whom approximately 500 are political prisoners. Many were arrested during the October escalation without formal charges. It is known that since October 7, at least 53 Palestinian prisoners have died in Israeli military detention centers and prisons. As of September 2024, Israel is holding 9,844 Palestinians as "security" detainees, including 2,061 convicts, 2,848 pretrial detainees, and 3,323 administrative detainees held without trial. Israel also holds 1,612 people as "unlawful combatants."

Conditions of detention: Both Palestinian and Israeli prisoners report harsh conditions of detention. Palestinian prisoners detained by Israeli forces are subjected to ill-treatment, physical violence, and psychological pressure. Israeli prisoners in Hamas hands also face harsh conditions, such as isolation and deprivation of medical care

Recorded violations: executions, torture, and mistreatment

Civilians

The October escalation of the conflict was accompanied by numerous violations of the rights of civilians on both sides.

Violations of the rights of Israeli civilians: According to Israeli organizations, civilians captured by Hamas reported harsh conditions of detention, including physical violence and moral pressure. For example, some Israeli hostages noted that they were subjected to torture and threats against their families.

Violations of the rights of Palestinian civilians: Palestinian civilians detained by Israeli forces are subjected to torture and ill-treatment. According to human rights organizations, about 80% of Palestinian prisoners reported being tortured during interrogations.

Prisoners of war and civilian hostages held by Hamas

Violations of the rights of prisoners of war and civilian hostages became a critical issue in the context of the escalation.

Torture and mistreatment of Palestinian prisoners: Palestinian prisoners detained by Israeli forces are often subjected to harsh conditions of detention, including physical violence, prolonged interrogations without a lawyer, and being held in horrific conditions. According to the human rights organization "B'Tselem," 98% of Palestinians who underwent interrogations confirm the use of torture.

Conditions of detention for Israeli prisoners: Israeli prisoners captured by Hamas are subjected to mistreatment, including deprivation of food, water, and medical services. According to reports from international organizations, there is evidence of the deaths of some Israeli prisoners due to poor conditions of detention.

Negotiations, releases, and exchanges: history, dynamics, prospects

History of releases and exchanges

The October 2023 escalation was another test for the prisoner exchange negotiation process.

Hostage-taking and exchanges: Historically, prisoner exchanges have often been used to reduce tensions. In previous years, Israel released hundreds of Palestinian prisoners in exchange for its citizens. The October escalation led to new demands for exchanges, with Hamas, in particular, insisting on the release of 1,000 Palestinians in exchange for Israeli hostages.

Dynamics of negotiations

The process of negotiating the release of prisoners following the October escalation has been marked by significant difficulties.

Political demands: Hamas has demanded that Israel release a large number of Palestinian prisoners in exchange for Israeli hostages. Israel insisted on the release of all civilian hostages as a precondition for further negotiations.

The role of international mediators: The negotiations took place with the participation of international mediators, in particular the UN and Arab countries, who tried to facilitate the reaching of agreements. However, the tension between the parties significantly complicated the process.

Prospects for exchanges and releases

The further development of the situation with prisoners and hostages will depend on the negotiation process.

International pressure and sanctions: International pressure may facilitate the release of some of the prisoners, but the final resolution of the issue remains uncertain due to continued hostilities and political instability in the region.

Humanitarian action: International humanitarian organizations continue to call for access to captives, as well as humanitarian assistance to affected civilians on both sides. According to the ICRC, more than 300,000 Palestinians are in need of urgent humanitarian assistance.
